Terms of Service

1. Acceptance of Terms

By using PixTagger (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These Terms form a binding agreement between you and PixTagger.

2. Description of Service

PixTagger generates AI-assisted titles, descriptions, and keyword metadata for stock photographs and video clips, formatted for Adobe Stock CSV, Getty Images / iStock CSV, and social media hashtag exports. The Service is provided on an "as-is" basis and the quality of generated metadata depends on the content you upload and on third-party AI providers.

3. Your Content

You retain all rights to the photographs and video clips you upload ("Your Content"). By uploading Your Content, you grant PixTagger a limited, non-exclusive license to process it for the sole purpose of generating metadata for you. We do not claim ownership of Your Content and we do not redistribute, republish, or sell it.

You represent and warrant that you have the necessary rights to upload Your Content — including, where applicable, model releases, property releases, and licenses. PixTagger is not responsible for unauthorized uploads.

4. AI Processing and Third Parties

The Service uses OpenAI's API (gpt-4o-mini vision model) to analyze your uploads. As of the date of these Terms, OpenAI does not use API inputs or outputs to train its models — see OpenAI API data usage policies. We pass Your Content to OpenAI only for the duration of a single tagging request and never share it with any other third party.

5. Acceptable Use

You agree not to upload content that is unlawful, infringes the intellectual property of others, depicts minors in any sexual context, contains malware, or is intended to harass or defame. We may suspend or terminate access without notice for violation of this section.

6. Service Availability

We strive for high uptime but do not guarantee uninterrupted access. The Service may be unavailable for maintenance, due to third-party outages (including OpenAI), or for other reasons outside our control.

7. Limitation of Liability

To the maximum extent permitted by law, PixTagger's total liability arising out of or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of the Republic of Serbia, without regard to its conflict of law principles. Any dispute shall be resolved in the competent courts of Belgrade, Serbia.
